Alderman Arnett on City Council Meeting

The following was provided by Ross Arnett (D-8):
The Special Meeting of the Annapolis City Council will be held on Monday 22 March at 7 p.m. in the Council Chambers. A public hearing will be followed by a legislative session. All Council meetings are broadcast on Comcast channel 99 and on Verizon channel 34.

At 5:30 PM there will be a brief reception for the Council and members of the HACA Board of Directors, followed by a joint session with the HACA Board and the council from 6 to 7 PM.   continued...

Reports by committees

Comments by the general public: A person appearing before the City Council with a petition, report or communication shall be limited to a presentation of not more than three minutes.

PUBLIC HEARING

O-27-09 Restaurant Liquor Licenses and Hours [Moyer, Finlayson, Hoyle, Paone, Shropshire]– For the purposes of authorizing restaurants serving alcohol in the C2 and C2A zoning districts to remain open beyond midnight and permitting the issuance of 2 a.m. restaurant-class liquor licenses (Class B.x) in the C2 and C2A zoning districts.

O-35-09 Stadium as Conforming Use in R2 Zoning District [Moyer, Paone] – For the purpose of establishing a stadium as an additional conforming use within the R2 Single-Family Residence Zoning District.

O-45-09 Subdivision of Nonconforming Properties [Moyer] – For the purpose of permitting the subdivision of nonconforming properties.

O-07-10 Receipt, Deposit, and Expenditure of Grants [Israel] – For the purpose of establishing rules governing the application for, receipt, deposit, and expenditure of grants by the City of Annapolis.

LEGISLATIVE ACTION


Below is the agenda for the legislative part of the meeting with a brief description. I have added comments in italics and underline after some of the legislation. I indicate my likely vote with my comments, but send these email blasts out to give you a chance to let me know if you think I’m headed in the correct direction or should change my mind. It is my practice to comment only on legislation that has had a public hearing and has gone through the Council Committee process.

CHARTER AMENDMENTS & ORDINANCES – 2ND READING

O-66-09 2nd R. Operation of Mobile Food Service Facilities [Hoyle] – For the purpose of clarifying the licensure restriction on a mobile food service facility that prepares and sells food in a vehicle operated in a residential area. This Ordinance is prompted by an Hispanic mobile food truck serving customers in Wards 3 and 4. At issue is the generation of trash and late night groups gathering around the truck. In my view this is an enforcement issue. In addition, the ordinance affects virtually the entire City, not just Wards 3 and 4. Finally, the Council has asked for legal advice from the Office of Law and enforcement information from DNEP. This will be deferred until the Council receives the requested information.

O-69-09 2nd R. Financial Advisory Committee [Israel] – For the purpose of establishing the Financial Advisory Committee. This legislation is a follow on from the Blue Ribbon Committee on City Finances, which in my opinion provided very good analysis and recommendations. The City needs this type of citizen review. I will vote in favor.

CHARTER AMENDMENTS, ORDINANCES & RESOLUTIONS – 1ST READING

CA-03-10 1st R. City Manager Form of Government II [Finlayson, Silverman, Hoyle, Kirby]– For the purpose of clarifying the role of the city manager as chief administrative officer; enhancing the supervisory powers of city manager with respect to departmental directors; and, providing that the dismissal of the city manager must be approved by the mayor.

CA-04-10 1st R. Chief Administrative Officer [Cohen] – For the purposes of clarifying the role of the chief administrative officer; enhancing the supervisory powers of chief administrative officer with respect to departmental directors; and, providing that the chief administrative office shall be appointed by the mayor and confirmed by the City Council.

O-06-10 1st R. Contractual Employment [Israel] – For the purposes of specifying how a position of contractual employment with the City of Annapolis shall be created and filled; and, revising the definition of “excluded service” and the scope of the civil service system.

R-07-10 1st R. First Sundays 2010 [Cohen, Israel, Paone] – For the purposes of waiving the license requirement for the sale of arts-related merchandise in the Historic District at the First Sunday events and waiving certain fees associated with City services in conjunction with these events.

R-08-10 1st R. Maryland Avenue Festivals [Cohen, Israel] – For the purposes of waiving the license requirement for the sale of merchandise during the Maryland Avenue Festivals and waiving fees for City services to be provided in conjunction with the Festivals.

R-10-10 1st R. Honoring Fire Chief Jerome W. Smith [Cohen, Israel] – For the purposes of honoring the dedicated and exemplary service of Fire Chief Jerome W. Smith to the City of Annapolis.
