City Council Meeting March 8--Budget and State of the City

This City Council meeting will feature the State of the City Report and the presentation of the budget.

Yep. Be there or be...something or another...I expect three members of City Council in particular to be rather unhappy.

FY 2011 BUDGET

O-09-10 1st R. Annual Operating Budget: FY 2011 [Cohen] - For the purposes of adopting an operating budget for the City of Annapolis for the Fiscal Year 2011; appropriating funds for expenditures for the Fiscal Year 2011; defraying all expenses and liabilities of the City of Annapolis and levying same for the purposes specified; specifying certain duties of the Director of Finance; and, specifying a rate of interest to be charged upon overdue property taxes.

R-05-10 1st R. Capital Improvement Budget and Program: FY 2011 to FY 2016 [Cohen] - For the purposes of adopting a capital improvement budget for the Fiscal Year 2011, and a capital improvement program for the six-year period from July 1, 2010, to June 30, 2016.

R-06-10 1st R. FY 2011 Fees Schedule Effective July 1, 2010 [Cohen] - For the purpose of specifying fees that will be charged for the use of City services for



LEGISLATIVE ACTION


Below is the agenda for the legislative part of the meeting with a brief description. I have added comments in italics and underline after some of the legislation. I indicate my likely vote with my comments, but send these email blasts out to give you a chance to let me know if you think I’m headed in the correct direction or should change my mind. It is my practice to comment only on legislation that has had a public hearing and has gone through the Council Committee process.

ORDINANCES & RESOLUTIONS – 2ND READING

O-35-09 2nd R. Stadium as Conforming Use in R2 Zoning District [Moyer, Paone] - For the purpose of establishing a stadium as an additional conforming use within the R2 Single-Family Residence Zoning District. On agenda due to 180 Day Rule This is on the agenda because of the 180 day rule, but has not gone to the Rules Committee. Now that we have a report form the Planning Commission, we will take this up at the next meeting of Rules and then it can come to Council for action. I will vote to table until after Committee action.

O-38-09 2nd R. Waiver of Fees [Stankivic] - For the purpose of permitting the City Council to waive fees of less than $500 for use of City facilities and services by resolution. This was given an unfavorable report by the Office of Law

O-45-09 2nd R. Subdivision of Nonconforming Properties [Moyer] - For the purpose of permitting the subdivision of nonconforming properties. On agenda due to 180 Day Rule. Again, this is on the agenda because of the 180-day rule, but has not gone to the Rules Committee. Now that we have a report form the Planning Commission, we will take this up at the next meeting of Rules and then it can come to Council for action. I will vote to table until after Committee action.

O-61-09 2nd R. Line-Item Annual Operating Budget [Cordle] - For the purpose of establishing a line-item requirement in any annual operating budget adopted by the City Council. The Finance Committee reported this out unfavorably, but I feel it is necessary if the Council is ever to understand what is really going on within the City Budget. All too often the Council finds that spending is occurring and we were unaware. Once the spending was uncovered, often we found that we would not have approved, or at least, we would have wanted more information. I will vote in favor.

O-64-09 2nd R. Building Board of Appeals [Moyer] - For the purpose of codifying the composition and qualification requirements of the City of Annapolis Building Board of Appeals. On agenda due to 120 Day Rule This is on the agenda due to the 120 Day Rule, but has not cleared the Rules in City Government Committee. There have been some technical concerns raise about this legislation and I will ask that it be tabled until it has a hearing before the Rules and City Government Committee.

O-66-09 2nd R. Operation of Mobile Food Service Facilities [Hoyle] - For the purpose of clarifying the licensure restriction on a mobile food service facility that prepares and sells food in a vehicle operated in a residential area. The Economic Matters Committee reported this out favorably, but I disagree. The legislation limits mobile food service to industrial zones only and would preclude food service outside the Boat Shows and many other events around the City. The primary reason given for this legislation is that the food services generate trash, which seems to be an enforcement issue, not a reason for banning all together. I will vote against this Ordinance.

R-59-09 2nd R. Imposing a Hiring Freeze [Cordle] - For the purpose of imposing a hiring freeze in the City of Annapolis, effective upon passage of resolution. The time for this legislation is long passed as the new Mayor has already imposed such a freeze. The Finance Committee reported this out unfavorably and I agree, and I will vote no.

R-67-09 2nd R. Street Rights-of-Way in Mary’s Mew Subdivision [Cordle] - For the purpose of privatizing the street rights-of-way in the Mary’s Mew subdivision in accordance with Section 20.24.170 of the Code of the City of Annapolis. Resolutions do not normally go to Committee, and this resolution followed that practice. I’m not aware of any public hearing for this resolution either. Thus I have no basis upon which to vote. Unless any of you have an opinion to offer, I will wait until the Council meeting, ask questions, and decide my vote at that time.

CHARTER AMENDMENTS, ORDINANCES & RESOLUTION – 1ST READING

CA-02-10 1st R. City Council Meeting Dates [Israel] - For the purpose of specifying that the City Council shall not meet during the month of November the year of a municipal general election.

O-08-10 1st R. Establishment of Transportation Committee [Israel, Cohen, Arnett, Pfeiffer]- For the purpose of establishing the Transportation Committee, a standing committee responsible for reviewing all proposed amendments to Titles 12, 14, and 22 of the Annapolis City Code.

R-04-10 1st R. March Madness Sidewalk Sale in Downtown Annapolis [Israel] - For the purpose of permitting the temporary sale of merchandise and non-alcoholic items in front of participating businesses on specified sidewalks in connection with the March Madness Sidewalk Sale organized by the Annapolis Business Association to be held on March 26, 27, and 28, 2010.
