Arnett On City Council Meeting Tonight

The Special Meeting of the Annapolis City Council of the Annapolis will be held on Monday, October 5, 2009 at 7:00 p.m. in the Council Chambers. The public hearing will be followed by a short legislative. All Council meetings are broadcast on Comcast channel 99 Verizon channel 34.

Below is the agenda for the meeting with a brief description. I have added comments in italics and underline after some of the legislation. I indicate my likely vote with my comments, but send these email blasts out to give you a chance to let me know if you think I’m headed in the correct direction or should change my mind. It is my practice to comment only on legislation that has had a public hearing and has gone through the Council Committee process.

O-3-09 [Moyer] Height Limitation in MX Zoning District -- For the purpose of permitting in the MX Zoning District indoor theaters, accessory structures and/or architectural features such as clock towers to be up to 100 feet in height if attached to office and/or retail structures that are part of a Planned Development. (Referred to Planning Commission and Rules and City Government Committee)





O-36-09 [Stankivic, Shropshire] Display Requirements for the Sale of Lawn Fertilizer -- For the purpose of repealing the display restriction on phosphorous and phosphate fertilizers. (Referred to Housing & Human Welfare and Environmental Matters Committees)





O-43-09 [Israel] Definition of Codified Term -- For the purpose of defining “may not” as mandatory in the Code of the City of Annapolis. (Referred to Rules & City Government Committee)





O-44-09 [Cordle] Electronic Weapons -- For the purpose of permitting law enforcement personnel and members of the armed forces to possess and discharge electronic weapons while on duty in the performance of official authorized functions. (Referred to Public Safety Committee)





R-49-09 [Cordle] Amending Fines Schedule for Electronic Weapons -- For the purpose of amending the fines schedule for electronic weapons violations. (Referred to Finance and Public Safety Committees)





O-46-09 [Moyer] Concentration Limit of Housebarges -- For the purpose of permitting a housebarge concentration of two percent in marinas with fifty or more slips. (Referred to Environmental Matters and Maritime Advisory Board)





O-47-09 [Stankivic] Regulation of Taxicabs -- For the purposes of prohibiting the use of a taxicab’s horn to announce its arrival or departure and specifying taxicab permitting standards. (Referred to Public Safety Committee)





R-50-09 [Stankivic] Amending Fines Schedule for Taxicab Violations -- For the purpose of revising the fine for taxicab violations. (Referred to Finance and Public Safety Committees)





O-48-09 [Moyer] Port Wardens – Notice of Hearings and Permitting Procedures -- For the purposes of specifying advertisement requirements for Port Wardens hearings and modifying permitting procedures. (Referred to Port Wardens)





O-49-09 [Moyer] Lease of City Property: Boat Shows in 2015 -- For the purposes of specifying advertisement requirements for Port Wardens hearings and modifying permitting procedures. (Referred to Port Wardens)





O-50-09 [Arnett] Lease of City Property: Melges 24 World Championship -- For the purpose of authorizing a lease of municipal property located in the general harbor area to the Eastport Yacht Club from October 23 – 31, 2009, to conduct the Melges 24 World Championship, a sailing race. (Referred to Economic Matters Committee)





LEGISLATIVE ACTION





ORDINANCES 2nd READING





O-13-09 2nd R. Graffiti Vandalism [Moyer] - For the purposes of classifying graffiti as a misdemeanor crime; specifying what acts constitute a violation of the ordinance; and, providing punishment by fine, imprisonment, and order of restitution. (Travels with R-25-09; referred to Public Safety Committee) Graffiti is a growing problem and the Chief of Police has asked us for this power in order to deter these activities. I will vote in favor of this ordinance and the associated resolution below.





R-25-09 2nd R. Amending Fines Schedule for Graffiti Crimes [Moyer] - For the purpose of establishing a fine and term of imprisonment for the crime of graffiti vandalism. (Travels with O-13-09; referred to Finance and Public Safety Committees).





O-14-09 2nd R. Temporary Parking Permits for Medical Personnel [Israel] - For the purposes of establishing multiple-day and single-day temporary parking permits for persons rendering medical care to a resident in a special residential parking district and directing the Council to set the permit’s fee. (Travels with R-27-09; referred to Finance and Public Safety Committees and Parking Advisory Commission. This is to allow temporary for visiting health professionals, mostly visiting nurses, to park near their patients to deliver services. I will vote in favor of this ordinance and the associated resolution below





R-27-09 2nd R. Amending Fees Schedule for Temporary Parking Permits [Israel] - For the purpose of establishing a fee for multiple-day and single-day temporary parking permits for medical personnel. (Travels with O-14-09; referred to Finance and Public Safety Committees and Parking Advisory Commission).





O-15-09 2nd R. Removal of Refuse Containers [Israel, Shropshire, Arnett] - For the purpose of requiring the removal of refuse containers from public view throughout the City of Annapolis. (Referred to Housing and Human Welfare Committee). The intent of this legislation is to keep trash receptacles out of public view and I support that. But some of our old historical city have situations that can not meet this requirement, so we may need to add some ability for exceptions to this new rule. I will discuss this on the floor of the Council and make a decision on my final vote at that time. Your input is most welcome.





O-28-09 2nd R. Billing for Emergency Medical Services [Stankivic] - For the purposes of establishing billing to hospitals and nursing homes for the use of City emergency medical services and directing the City Council to set the fee for these services in the annul fee schedule. The intent of this legislation is to allow the City to recover insurance payments for ambulance service. Currently, insurance companies accept premiums for this coverage, but the city bears the cost. I will vote in favor.





O-50-09 2nd R. Lease of City Property: Melges 24 World Championship [Arnett] - For the purpose of authorizing a lease of municipal property located in the general harbor area to the Eastport Yacht Club from October 23 – 31, 2009, to conduct the Melges 24 World Championship, a sailing race. (Referred to Economic Matters Committee). This legislation is on a fast track because the championships run 22 through 24 October. In addition to being consistent with our role as the Sailing Capital of the Nation, this event will generate much needed revenues for downtown businesses. I will vote in favor.





O-32-09 2nd R. 2009 Comprehensive Plan [Moyer] For the purpose of adopting a new comprehensive plan for the City of Annapolis. After extensive input form all concerned the Council will offer several amendments to the plan submitted by the Planning Commission. Both the Commission and Planning and Zoning have agreed with these changes. I will vote in favor.





RESOLUTIONS 2nd READING





R-35-09 2nd R. Towing Rates [Cordle] - For the purposes of increasing towing rates for towing companies licensed by the City of Annapolis and authorizing additional minimum charges. (Referred to Public Safety, Finance, and Economic Matters Committees).





ORDINANCES 1st READING





O-59-09 1st R. Stormwater.Management [Moyer] – For the purpose of revisiting stormwater management standards in conformity with Maryland State Law.





RESOLUTIONS 1st READING





R-57-09 1st R. Kids at Hope [Moyer] -- For the purpose of declaring the City’s support for the Kids at Hope Program and committing to the principles expressed in this Resolution.
