Ward Eight Alderman Arnett on Monday Night's Council Meeting

The following is from Alderman Ross Arnett:

Ward 8 Residents

The Special Meeting of the Annapolis City Council will be held at 7 p.m. in the Council Chambers. A public hearing will be followed by a legislative session. All Council meetings are broadcast on Comcast channel 99 and on Verizon channel 34.

PUBLIC HEARING

CA-01-10 Deputy Department Directors - For the purpose of requiring department directors, subject to mayoral approval, to designate a full-time employee as deputy director.

O-01-10 Art in Public Places Commission – Residency Requirement - For the purpose of specifying that residency in the City of Annapolis is a requirement solely for appointment to the Art in Public Places Commission

O-02-10 Standing Council Committee Rules - For the purpose of establishing Council committee rules governing the conduct, notice, venue, and time of committee meetings.

O-03-10 Art in Public Places Commission – Powers - For the purpose of redefining the powers of the Art in Public Places Commission to include placement of additional signage and recognition of landscape art.

R-01-10 Bertina A. Nick Way – For the purpose of declaring that Obery Street shall be renamed “Bertina A. Nick Way.”

R-02-10 Revision to FY 2010 Fees Schedule - For the purpose of revising fees charged for the use of City services during FY 2010.

LEGISLATIVE ACTION


Below is the agenda for the legislative part of the meeting with a brief description. I have added comments in italics and underline after some of the legislation. I indicate my likely vote with my comments, but send these email blasts out to give you a chance to let me know if you think I’m headed in the correct direction or should change my mind. It is my practice to comment only on legislation that has had a public hearing and has gone through the Council Committee process.

ORDINANCES & RESOLUTIONS – 2ND READING

O-52-09 2nd R. Residential Properties Subject to Foreclosure [Shropshire, Paone] – Registration and Maintenance - For the purposes of requiring the registration of residential properties subject to foreclosure with the Department of Neighborhood and Environmental Programs and providing civil penalties for failure to register. On agenda due to 120 Day Rule. Travels with R-56-09 While well intended, I believe that there are just too many flaws with this legislation, especially including the fact that it is unenforceable. I will vote no.

R-56-09 2nd R. Amending Fines Schedule for Foreclosure Registration Failure [Shropshire, Paone] – For the purpose of specifying the fine for failure to register properties subject to foreclosure. On agenda due to 120 Day Rule Travels with R-56-09 See O-52-09 above.

O-65-09 2nd R. Uses Deemed Conforming Within the R2-NC District [Moyer, Arnett] – For the purpose of adding “two-family dwelling” to the list of uses deemed to be conforming in the R2-NC District, provided they were legally existing on November 19, 1990. This legislation is to correct errors made when Title 21 Zoning Code was reorganized and simplified in 2005. Currently all duplexes in the R2NC zone are nonconforming. This ordinance will rectify those errors. I will vote yes.

O-70-09 2nd R. Order of City Council Voting - For the purpose of ordering City Council voting by rotating sequence, with the Mayor voting last. The current system is for the Mayor to vote first and the Aldermen to vote in order of Ward starting with Ward One. The new system will have the voting rotate by Council meeting. So Ward One will vote first at the first meeting in March, Ward 2 will vote first for the second meeting in March and so on. The City Clerk will be charges with keeping track of the rotation. I will vote in favor.

ORDINANCES & RESOLUTIONS – 1ST READING

O-05-10 1st R. Single-Family Attached Dwellings in C1A Special Conservation District - For the purpose of deeming conforming those single-family attached dwellings lawfully existing on June 20, 1994, in the C1A Special Conservation Residence District.

O-07-10 1st R. Receipt, Deposit, and Expenditure of Grants - For the purpose of establishing rules governing the application for, receipt, deposit, and expenditure of grants by the City of Annapolis.
